Dowd Bennett represents clients in litigation — and does nothing else. We assist our clients at all phases of a potential dispute, up through trial and appeal. Since its formation in 2006, the firm has represented some of the most recognized names in business in their important cases across the country. We have been lead trial or appellate counsel in cases litigated to verdict and judgment for Wal-Mart Stores, Monsanto, Valero Energy, Emerson Electric, Anheuser-Busch, Fresenius Medical Care, Ernst & Young and others. Our philosophy is to learn the nature of the dispute as quickly as possible, formulate with our clients a strategy for the matter, and then aggressively pursue that strategy. We pride ourselves in being able to not only help our clients through the litigation or investigation process but also in presenting our clients’ evidence at trial.
Trial practice is an important part of what we do. In 2006, our lawyers won a $21 million verdict in a four-week trial in the United States District Court for the Eastern District of Missouri. The Eighth Circuit affirmed the judgment and the client recovered the full amount of the judgment, plus interest and costs. In 2007, our lawyers prevailed in defending a $100 million professional negligence and fraud case brought by the St. Louis transit authority against four engineering firms. The case was the longest-running trial in the history of St. Louis County and settled on appeal with our opposing party agreeing to pay the judgment entered in our favor on our counterclaim and attorneys fees. The jury ruled for our clients on all 12 counts. Our lawyers examined and cross examined more than 35 witnesses in that case. In 2008, firm lawyers prevailed in a $280 million trial in the Delaware Court of Chancery regarding the formation and ownership of a major hedge fund. In 2009, the Delaware Supreme Court affirmed the judgment. In 2010, we obtained three verdicts in major cases. In February, our client prevailed in a month-long False Claims Act case in the U.S. District Court for the Western District of Texas. In April, our client obtained a jury verdict in an age discrimination case brought by the U.S. Equal Employment Opportunity Commission in the U.S. District Court for the Eastern District of Missouri. And in July we prevailed for Monsanto against Conoco Phillips. In 2011 and 2012, we continued success with a victory at arbitration for Ernst & Young, a major trial for Emerson Electric resulting in a favorable judgment, and successful appeals in multiple circuit courts, including the reversal of an $82 million judgment against our client in a case brought by the Department of Justice. Also in 2012, we obtained a $95 million verdict in a trial in the District of Massachusetts against the tax division of the United States Department of Justice.
Our members include a former United States Attorney, two former United States Supreme Court clerks, three former clerks to the United States Court of Appeals, four former clerks to District Court judges, a former State Supreme Court clerk, three former Assistant United States Attorneys, and a former Missouri State prosecutor. Our lawyers have big-case experience at the highest levels in any jurisdiction and are prepared to take these cases through trial and appeal.
