Established in 1997, Hudson Cook is a one-stop shop for consumer financial services regulation for creditors, serving as a go-to firm for efficient and authoritative answers to questions about compliance with federal and state law, exam preparation and support, and zealous advocacy on behalf of its clients involved in investigations by government financial services regulators. Located across the country, our experienced, resourceful lawyers offer legal services to local, national and international clients, providing practical and innovative solutions to their legal issues.
As the only boutique firm in the United States focused exclusively on financial services compliance, regulation, enforcement, and supervision, Hudson Cook brings a wealth of knowledge and experience to clients regulated by the area’s hyper-complicated and interrelated laws and regulations. The firm’s deep bench of attorneys provides coverage and resources to clients for a wide range of consumer credit products and services, including auto finance, mortgage finance, small-dollar loans, alternative finance, student loans, installment loans, short-term lending, credit cards, and merchant cash advance. Additionally, the firm provides support to industry vendors and trade associations.
The government investigations, examinations and enforcement practice, centered in the firm's Washington, D.C. office, has been working with creditor clients for a number of years to help them prepare for examinations and resolve investigations and enforcement actions with federal regulators, such as the Consumer Financial Protection Bureau, Federal Trade Commission, U.S. Department of Justice, state regulators and state Attorneys General. This practice group features a number of partners who have seen government regulation from both sides of the table.
The firm helps depository and non-bank financial institutions proactively plan and execute new products, maintain the compliance of their ongoing services, and respond to changes in the laws and regulations. Hudson Cook has remained at the forefront of consumer financial services counsel legal issues as new developments have unfolded in past decades, including the onset of internet lending and increased federal regulation under the Dodd-Frank Act. The firm has also defended many clients subject to Consumer Financial Protection Bureau (CFPB) investigations and routinely counsels clients on implementing compliance management systems designed to survive CFPB scrutiny. Hudson Cook attorneys approach matters with a focus on compliance to avoid or mitigate the potential for investigation and enforcement.
In the event clients do face regulatory scrutiny, its lawyers work hard to negotiate outcomes designed to minimize or mitigate penalties and other costs. The firm has earned respect from regulators for its attorneys’ honesty, knowledge, persistence, and integrity. By maintaining an in-depth understanding of state regulation of the consumer financial services industry, the firm’s attorneys can avoid spending hours of research on finding the law applicable to a particular issue and instead focus on providing efficient, expedient, and accurate answers to clients. The firm is always cognizant of what it “doesn’t know,” and is quick to refer clients to third-party counsel on matters outside the firm’s comfort zone.
Hudson Cook boasts a number of partners with experience in senior positions in regulatory agencies, including at the CFPB and FTC. Others held senior in-house positions at auto finance entities, banks, and other financial services institutions. The firm understands the business of consumer financial services, allowing it to anticipate opportunities or obstacles and identify solutions that best advance its clients’ goals in the context of each client’s particular operational environment. In acknowledgment of their prominent standing in consumer financial services law, a number of Hudson Cook attorneys hold leadership positions in numerous legal and industry groups, as well as membership in the American College of Consumer Financial Services Lawyers, “a professional association of lawyers particularly skilled and experienced in handling consumer financial services matters and dedicated to the improvement and enhancement of the skill and practice of consumer financial services law and the ethics of the profession.”
The firm's lawyers are thought leaders in the industry regularly speaking and publishing articles on consumer financial services compliance topics.
