- Representing health care providers and
suppliers in Medicare Administrative Contractor (MAC), Blue Cross, and
other payer audits and appeals.
- Representing health care professionals in
licensing cases and payer disaffiliation and de-participation appeals.
- Preparing, negotiating, and advising on
health care contracts, including employment and independent contractor
agreements, management agreements, billing services agreements, confidentiality
and non-disclosure agreements, clinical trial agreements, and medical
records custody agreements.
- Assisting health care providers,
businesses, and professionals with their compliance endeavors, including:
drafting compliance programs tailored to the client's organization;
conducting compliance audits; developing and conducting compliance program
training; leading compliance investigations and responding to identified
problems; counseling providers with regard to sensitive refund and
disclosure issues; drafting compliant contracts and internal policies.
- Assisting Covered Entities and Business Associates
with HIPAA and HITECH compliance, including: responding to OCR complaints;
analysis of breaches and notifying patients of breaches; drafting
policies, procedures, and forms required by the Privacy and Security
rules; drafting and negotiating Business Associate agreements; and
conducting HIPAA compliance audits and training.
- Advising health care providers and
suppliers on compliance with the Anti-Kickback Statute and Stark,
including advice regarding self-disclosures under the OIG’s Provider
Self-Disclosure Protocol and Stark Self-Referral Disclosure Protocol, and
analysis of a variety of arrangements under Anti-Kickback Statute
exceptions and safe harbors and Stark ownership and compensation
- Consulting with and assisting business
& transactional, employment, litigation, criminal defense, and other
attorneys on health care regulatory and compliance issues impacting their
representation of health care industry clients in a variety of matters,
including: entity formation; mergers & acquisitions and sales; joint
ventures; Stark and fraud & abuse opinions; contracts; health care
fraud; and licensing defense.
