I am the president of a not-for-profit 501 (c) (3) community organization (Aquinnah/Gay Head Community Association, known as "AGHCA") which is located in the town of Aquinnah on Martha's Vineyard. Aquinnah is also the "home" of what is now a federally recognized tribe. Hale and Dorr and then its "successor" Wilmer Cutler Pickering Hale and Dorr have been our attorneys since the mid-1980s when our organization was deeply involved together with the town of Gay Head, (now named Aquinnah) and the Commonwealth of Massachusetts in negotiating a complex Settlement Agreement in 1983 among the then tribal council, town, commonwealth and our organization and then in "procuring" the requisite enabling statutes by both the US Congress and the commonwealth of Massachusetts (in 1987 and 1985 respectively). Among other effects, the Settlement Agreement and these statutes removed the cloud of Tribal claims to take back "privately owned" lands in the town and provided the Tribe with $4 million to acquire a significant parcel of land in the town which now serves as its headquarters and also contains a Tribal housing development. These statutes also precluded the Tribe from establishing a casino in the Town and require Tribal general adherence to Town statutes, zoning by-laws, etc. with respect to Aquinnah "land developments." Over five years ago, the Tribe announced that it would be developing a limited (electronic machines only) casino in the town of Aquinnah predicated on its "conviction" that the Federal Indian Gaming Reform Act of 1988 ("IGRA") overrode the provisions in the above mentioned 1987 Federal Act, which precludes such a development. Litigation in a US District Court in Massachusetts was then instituted by the Commonwealth, the town, and AGHCA, each with separate counsel. We collectively "won" on all material issues in that court. The Tribe then appealed to the Federal First District Court of Appeals, which (surprisingly, frankly) reversed the lower court based on its conclusion that the 1988 IGRA did override the 1987 Act with respect to the right to develop a casino of the type envisioned by the IGRA. The Commonwealth, the town and AGHCA then sought a writ of certiorari from the US Supreme Court which (not-surprisingly, given the "odds") was denied several months ago. As indicated above, Wilmer Hale has been our counsel throughout what I will call the casino saga. In an earlier email, I advised that I am a retired partner of Gibson Dunn & Crutcher (corporate and banking). I was a billing partner for a diverse number of clients and matters and also developed what I consider to be a keen sense for the "quality" (both generally and in terms of "value" to the given client) both of my own firm and others with whom we were interacting, including with respect to complex litigation since a number of "my" clients frequently found themselves engaged in same. In doing so, I was able to develop impressions of many other major firms over the years. I cannot be more positive about my feelings about the general and consistent quality and "value received' with respect to the work Wilmer Cutler Pickering Hale and Dorr has performed for AGHCA. The staffing by Wilmer Cutler Pickering Hale and Dorr has always been on the "lean" side, which for a small not-for-profit was deeply appreciated, and the partners, of counsel, and associates we have interacted with have always provided sound (and clear, not always a given with attorneys) and timely advice, excellent memoranda, briefs and well-thought-out and effective oral arguments, etc. I know from conversations I've had that counsel for both the Commonwealth and the town share my impressions. I also just want to state that although we have "dealt" with many fine attorneys at Wilmer Cutler Pickering Hale and Dorr, the partner in charge for our "casino case" for what is now a number of years is Felicia Ellsworth. Put simply, Felicia is one of the finest attorneys I have ever had the pleasure to "work with.”
